       In Michigan, a married couple is separated when they live apart and lead separate lives, but they are legally separated when they obtain a Judgment of Legal Separation.

       Seeking a Judgment of Legal Separation has it benefits, for instances you and your spouse are trying to work on your relationship but the uncertainty of finical and legal future once divorced prevent reconciliation. Another more practical example,  when a legal separation maybe helpful is when a spouse’s employer provides the family health insurance a parties may choose to legal separate until such time each party can maintain their own health insurance.

         Michigan law requires Judgment of Legal Separation to provide some mechanism for the separation to end or be converted into a Judgment of Divorce.
