Judgment of Annulment is a “declaration of invalidity of marriage.”. Essentially the court would determine that your marriage is void i.e. like the marriage never happened for example if your spouse was still married at the time of your marriage, the latter would be void and be eligible for annulment. Likewise, if the marriage was between family members it would also be eligible for an annulment. The two previous examples are not the only reasons a marriage may be annulled, in fact they are not even the most common basis for annulment which is probably “fraud”. Nonetheless, despite the invalidity of a marriage, you are required to seek an annulment to make your marital status distinct.
Since the annulment laws are often complex, and it is a relatively rare request please contact my office to file your case in court, which is the circuit court of the county where you or your spouse reside.
When a judge grants an annulment, there will be no record of the marriage even existing by a court order. Spousal support is not available due to the invalidity and children of an annulled marriage are considered legitimate children of the marriage if born during the marriage or within 300 days after date of annulment. This means parents are obligated to pay child support and orders regarding child custody would be as though the marriage had been valid.
